- When is it requested to contact Alain Bellanger?

- How are purchases paid?

Purchases can be paid by credit card (Eurocard, Visa, Carte Bleue) via the secure payment server Paypal where you input your credit card details in a secure confidential area. Any other type of payments (check, bank transfer, etc.) may be accepted, but requires making an application to Alain Bellanger. The total price is shown on your order form in Euro and U.S. Dollar and includes the price of the artwork, its packaging, taxes and its delivery. The customer is always informed before final confirmation of his order delivery charges, taxes and customs related to his order, for which payment is included in the total amount requested by the client (including the price of the artwork or artworks plus delivery charges). Thus, confirmation of agreement to pay the order by the customer implies that the latter agrees to pay the shipping costs included in the quoted price. Delivery charges can therefore constitute a valid reason for questioning the order after its final registration.

- Lack of Payment

In the event of a lack of payment because of the refusal by the bank to honor the transaction or because of the opposition by the client on the deal, before or after completion of the transaction, Alain Bellanger may cancel the sale without notice or delay, and can, if necessary, require the  customer to pay the expense for the restitution of the work. It is understood that the accepted opposition will be the same as those granted by the institution credit card bank or credit.

- Data Privacy

We guarantee the confidentiality of information you give us. By confirming your order you authorize us to disclose the elements necessary for its treatment by our suppliers, partners, and other public or private organizations whose involvement is required for our full service orders, secured transaction, packaging, transport, insurance and shipping works.

When you confirm your order you authorize us to use your name and address (physical address and e) to send you the news and events related to the activity of www.bellanger-alain.com. You can modify the data or request their withdrawal from our databases in accordance with Law No. 78-17du January 6, 1978 (Computer and Freedom)

The security and confidentiality of your credit card information is secured by Paypal. Bank data are input directly on their website and not shared with Alain Bellanger.

- Delivery by Alain Bellanger

Alain Bellanger delivers the work at the given shipping address within an average of 10 days in France (the deadline may significantly lengthened in August), rarely exceeding 15 days overseas (depending on the customer's address). Upon request of the buyer, the artwork maye exceptionally be delivered in three days. The delivery must be signed by the buyer himself, as a proof in case of a claim. The buyer is responsible to bring to attention of any carrier the possible damage of the delivery or inform Alain Bellanger by mail within three days after receipt.

- Compliance with the order

The delivery slip will be considered as proof of its content. All artworks are sold on the website with a detailed description. The artwork may be returned if the content of the delivery did not match the slip.

 - Guaranteed satisfaction

For a period of seven working days from the effective date of delivery, you have the opportunity to contact us (by e-mail at This e-mail address is being protected from spam bots, you need JavaScript enabled to view it ) to return the intact artwork in its original packaging stipulating reasons for the return. Then Alain Bellanger will offer you another artwork (chosen by you) or refund the amount of your order (minus shipping cost) and let you know about the return's policy. This provision is in accordance with article L. 121-16 of the Code of Consumer Affairs. Shipping costs and the risks related to the return of an artwork shall be borne by the client.

- Billing

A confirmation of your order comes to you after validation of your banking data by the Bank. This document includes an invoice number and can be considered an invoice. - Rights on the artwork and property

The risks linked to the artwork are transferred to the buyer at the delivery. The rights attached to the artwork are transferred when the total amount of the artwork has been paid to Alain Bellanger. The artist at the origin of an artwork always holds the copyright on its creation. Alain Bellanger remains holder of the rights of representation and reproduction. The rights of the purchaser on the artwork are limited to a right to private use.

 
- Engagement of Alain Bellanger

Alain Bellanger undertakes to ensure meeting its commitments with respect to orders and delivery artworks as stipulated by the present conditions of sale. Alain Bellanger shall under no circumstances be held liable or deemed to have committed a fault in the processing of your application for a delay, or even partial failure of his appointment due to force majeure (pursuant to Rule 1148 Civil Code, as interpreted by the French law) or as a result of the failure of an act by one of its partners or suppliers. Alain Bellanger excludes any explicit or implicit guarantee on quality, site performance and the ability to carry out transactions. Alain Bellanger can not be held liable for any injury or complaint because of the inability to access the site, how it works, the suspension of a session of sale or transaction, the delay transmission of e-mails, presentation of a work or a breach. Like any website, Alain Bellanger can not guarantee that the site will be reliable, uninterrupted, error-free and virus-free. Alain Bellanger can not under any circumstances be held liable for damages of any kind which might arise directly or indirectly from the use of the site. His responsibility is in any case limited to 100 Euros.

- Law

The Agreement is governed by French law. Any dispute arising from the formulation, interpretation or execution of the Agreement shall be subject to the exclusive jurisdiction of the Courts of Paris. Our services are open to people with the legal capacity to contract under applicable law. In particular minors are not permitted to have access to our online sales service. Only the french text of these terms and conditions shall prevail. Translations into other languages are only given as information. If any provision shall be considered null and void by a court of competent jurisdiction, such invalidity shall not affect any other provisions which retain all their effects. The failure to exercise a right conferred by the present claims could not mean the waiver to that right.
